Weskan Grain (“Weskan”) and Colorado Pacific Railroad (“CXR”), two subsidiaries of the Soloviev Group, together with a group of local farmers, filed an antitrust lawsuit in federal court in Kansas seeking to stop Union Pacific Railroad Company’s (“UP”) anticompetitive and monopolistic conduct in western Kansas and eastern Colorado. Through a secret agreement with Kansas & Oklahoma Railroad (“K&O”) to impose exorbitant fees on rail traffic moving between western Kansas and eastern Colorado, UP has erected artificial competitive barriers on rail lines it owns in the region. These barriers have increased transportation costs and transit times, making it more difficult for local grain farmers to obtain a fair price for their crops and preventing shippers from accessing lower-cost alternatives.
