Ajamie LLP secured a complete victory for Shopify in the U.S. District Court for the Southern District of Texas. High Tech Republic, Inc. d/b/a Webinopoly filed suit against Shopify, but Ajamie partner Eric Chenoweth successfully moved to dismiss the case based on a mandatory forum-selection clause requiring disputes to be brought in Ontario, Canada.
The Court agreed with Shopify’s arguments, finding the forum-selection clause enforceable and rejecting Webinopoly’s challenges. As a result, the lawsuit was dismissed in its entirety without prejudice.
